I'm just gonna step in here for a quick second to clarify something regarding educational use of copyrighted material. In order for it to be used in a educational setting, permission must be saught from the copyright holder otherwise it is illegal to use said material. Trust me on this, we have a dedicated person in my building and her sole job is securing copyrights for the professors and securing permissions from others to use copyrighted material.

Please continue your debate.
 
Well, if you read Houston's and Proformance's posts -- I think you could actually consider this an educational institution, since they constantly lecture everyone here, on how to do things... xf:D


Having said that, it probably would be upheld as fair use, given the context in which it was posted -- it does seem to meet the criteria.
 
Call it what you want Rick. Some may take an offense to facts and information. Kinda reminds me of the people who yawn when the flight attendant is giving instructions for life jackets etc., then the plane crashes and they don't know what the hell to do.

While Val removed it, and it is a moderators prerogative, in it's use, it was limited and reasonable and therefore justified. You do not need to approve use in that context.

You have a lot to learn. No one is preventing him from commenting, critiquing, or even linking to the images he wants you to see.. but, the law does require permission before you can copy and upload or republish a photo.

All that aside, it is simply inappropriate to copy images from someone's website and post them somewhere else without permission. Had he been in the building and taken the picture himself I'd have a different opinion but, that is not the case. I expect people who view my photos to to do so from the gallery's original location where I retain the full promotional value for which it was published in the first place.

On a site where DJs constantly come seeking pictures and other content - I don't think it's too much to ask to not provide for them a ready buffet of other people's proprietary works without their consent. Try Copyscape sometime and when you come up with 23 DJs who have cut and pasted whole pages of your content into their sites, (including one who actually changed the by-line and tried to sell an article to a wedding site as his own work) you're attitude about where you want your stuff displayed will be much narrower.

My profile is empty because it works like a charm to protect my content. It's amazing how lazy people really are. Most chat room DJs believe that since my profile is empty I must be anonymous. Since I emptied all my chat profiles the instances of material stolen dropped to just 2 or 3 occasional cases. I don't and won't do gig logs, and don't want my pics posted here.

I'm not saying it was right, but I don't buy the argument that it's not allowable in the context it was used. The law does NOT require permission to use an image under certain circumstances and that was one of them ( http://www.copyright.gov/fls/fl102.html ).

You know, I messed up. I should've posted that it was ME who DJed a large-scale event, using a Passport, and wore a t-shirt while doing it.

You're overlooking the presence of other non-infringing ways to accomplish the same result as well as the physical characteristics of digital content. He created a new unattributed source file on a another server when in fact a text link to the original photo would have served the same purpose without the need to reproduce or copy anything. Fair use is not just any use that you choose to label a critique.

No you messed up by taking pictures of these DJ's and their setup when your focus should have been on the event you were getting paid to do. How did that turn out and what did you accomplish by showing us this? A true professional serious about DJing knows they wouldn't have ever used that system for a wedding reception or anything for that matter other then a small speaking/speech engagement.

So what have we learned from you posting these pictures? What not to use at a wedding reception? Most of us already knew this. If you posted this for us to have a good laugh then that would have been fine. But to post this putting down this DJ's setup and you don't show us yours saying yours isn't that big a deal is a new low. Are you ashamed of what you're working with? If you are then upgrade as soon as you can. Let's talk about you. Never mind those other DJ's. They may improve and they may not. What do you Ricky need to improve to make you a better DJ and how can we help? That's assuming you can keep an open mind and not take everything personal. I say that because that's what i had to learn what not to do. Just listen and trust that i don't know it all and listen to someone else tell me what to do. Then see what will work best for me. But always remembering to keep an open mind.

Not always easy for me to do once i let my ego get in the way thinking i know what i'm doing and don't need no help. DEAD WRONG ON MY PART!

Stick to the script and what's really the issue here.

We don't know who these DJ's are or anything about them. We don't know if they are just starting out and this is what they are starting out with. We don't know how the client got to find out about them and booked them. They might have placed an ad on craigslist looking for a DJ just starting out to do their wedding and all they have to spend is $200.00-$300.00.

Also my experience is that the real top of the line gear cost some nice money and not everybody has that kind of money to spend. Since November not including the camera I just bought, I've spent over 4k on gear. I sacrificed to get what I did get. Not everyone has that kind of money on gear. Then my experience has been I learned what to buy and what not to do through making mistakes some times.

What I bought I'm very proud of. It was costly but worth it.
