A Song On YouTube

I don't see the problem.... I am simply employing a player that happens to have the song loaded that I need to play.... I am not keeping a copy and it would be no different than tuneing into a radio station that also happened to be playing the song... I see no difference... as I can't keep either song.

Lordy Rob.....

I better stop here before you start going all "MOD" on me.....

You would need to pony up performance fees, to play a radio station stream at a gig. YT videos are for YOUR personal viewing pleasure -- working a paid gig is a commercial venture...

Just learn to say NO -- it's simply two letters... ;)

If not, then when another DJ walks in that doesn't have a song, and doesn't want to muck up their machine online during a gig, they will look bad, because you set a bad precedent for the industry...

Ok I'll try this one more time with smaller words....

You said smaller words.

Bride Says: Can you play "Super Duper Lover of Mine" by the Cheese Crew I'm so sorry I forgot to put it on my list and your final payment and possible tip relies on me hearing this song... can you play it?

Regardless of what the Bride says at showtime - I have warned them up front that if you have not identified a 'must play' song, then it may be a possibility that if you ask for it at showtime, I don't have it. They are very well aware of this. The 'must play' list is documented and approved. As someone stated previously, if you ask me on the day of, it is not my fault. You have been warned. To add, why would I risk my current performance over this?

You have two options here if this song isn't in your library:

A. Sorry Mrs Didn't ProvideEnoughInfo, but since I didn't know you would die if I didn't have or couldn't play this song but, I don't have it.... to which she runs to the bathroom and cries the rest of the night.... you don't get paid and definately no tip...

I will get paid - in fact, should have already happened.

B. Let me log into i-Whatever music source you use.... and see if I can get it.... a-ha... the only way I can play it is if I stream it from Youtube,,, give me a few minutes to let the video cache to memory... Tada done... I can play your song now... to which she hands you a fat envelope full of Benjamins and Franklins.... plus a few more Benjis from her mothers perse.

Which option would you choose? A or B

I wouldn't risk my machines to this. What guarantee do you have that it would get you more money? What guarantee do you have that the network you're on - supposedly some good connection - is not harmful to your system? This is definitely not a do or die situation. In all the years I've been performing, I have never had a serious issue with this scenario. This also teaches the client that they can always get what they want from you. In a professional environment, I will give you what you agreed to get and I will try my best to give you anything else. I will not risk my machines or any connections on your show for 'a' song. If the show becomes a flop because I connected to a network, that's my reputation being dragged through the mud. They don't understand you did it to please them. What they see is a failed show. If you happen to have a spare machine to connect to said network and you purchase a copy of the last minute song, then fine. Up until recently, TRY finding a beatles song online.

What happens if you're playing a stream and the stream breaks up while they're dancing? Fat envelope is now lost and btw, you're now the sucky DJ. That's a big risk I'm not willing to take on such a professional gig. Furthermore, I would never play from youtube at a show - even if I could. I don't own it, could be an unclean version, etc. You're opening yourself to unforeseen possible issues - all hanging on maybe you'll get a bonus. If you do the show according to your agreed documents, you most likely will get a bonus anyways. If you, the client, is going to penalize me over 1 song that you failed to identify, then so be it. I held up my end of the show and in most cases, went above and beyond what was required.

Bottom line is yes, it's splitting hairs and a very fine line.... is it piracy... maybe... but, the simple fact is, it is there to use.... and anyone who might want to press the copyright issue against the DJ or even the Venue would be hard pressed to do so... especially if all that was done was a song or video that was on a publicly available website was streamed and not saved then... chances are slim that anyone would be procecuted for it.

Two issues I see with regard to the OP

1. Would you play or stream music from an online source such as Youtube.

My answer is yes... I see no harm in allowing my system on the internet to do so.... (forget the whole is it piracy or not arguement).... my computer is going to be fine accessing the internet.

2. I think the other part was implied in meaning do you think your system is compromised by the potential low quality of said Youtube streams....

I think that is definately a risk... to which if you can you should always preview or prelisten to a track before playing live....

Now I know we've had a spirited conversation about the "legalities" of doing such but, that wasn't the original intent of the thread... it's just what it morphed into. Which is fine... it's good to have conversations such as this....

I may not agree but that doesn't make me right or wrong it's just my opinion.

Rob,

Forget the splitting hairs, and grey areas for a moment...

It's wrong on a number of levels, and shines a bad light on the entire industry. People who see you do this, will then expect all DJs to do this for them.

This is one of those things that give DJs a bad name... ;)

See it's this "Sorry Charlie" attitude that gets me when you do have the option to satisfy a client you refuse to... why, because you don't want to go on the internet... it just makes zero sense to me....
Don't allow other people's stupidity to become your emergency!

I see it as the equivalent as logging on to the defunct Limewire to get a song you don't have you're not paying for it. This thread has nothing to do with Amazon, iTunes, Grooveshark service with VDJ. etc. It's specific in using youtube to obtain the requested music. Hell I'm not in the business and if I don't have it at my party then I'm not playing it.

Can I buy you a Beer or two? You are absolutely, steadfastly and without question irrevocably correct.
Hey! Its an "office party" we are on the same page! :trismug:

Listen folks... you're never going to win an argument against using tools such as internet access at a live gig to get the job done as being a bad thing to do.... there is just no way you'll ever convince me of that..... if it's on youtube then the rights holders can not bitch if it gets used in a private party..... no rights are being infringed upon when it's on a public website such as Youtube for anyone at anytime to play.

So the record companies struggling to pull all this off of youtube is no big deal?

Well - to be honest, if you're rebroadcasting a radio station, you may have other issues too - They pay for the right to play that. In a similar fashion, you are being paid to play what you have the permission to play.

Look guys.... I agree with you on the copyright issue.... I'm only making outlandish scenerios (which obviously backfired on me or you's don't really know me that well) to show how riddiculous it is to say no to a client simply because you are afraid to use the internet....

It just absolutely floors me that if you have access to legitamite sources to purchase and play music that one wouldn't utilize them...

Listen folks for the record when I need a track at a gig I go to iTunes or Amazon.... and purchase the file...

I was mearly trying to put aside the "copyright" issue for the sake of the premise behind the threads OP....

Judge: Please read the verdict on the Deeeeeeee...fennn...daaaaaant! (This is how they say it in Texas)
Head Juror.Guilty as charged your Honor.
Judge: Deeeeeeee...fennn...daaaaaant, please rise! Do you have anything further to say before sentencing is passed on you?
Rob: Ummmmm, errrrr, Judge I am sorry....please don't take away my Internet! if you do, I can never be a hero at a Wedding again!
