It is insane to do any legitimate event, even a free one or for immediate family, without a contract. I repeat...INSANE!

I'm going to play Philadelphia lawyer here Cap. My understanding of a contract is there has to be some consideration given to both sides. If there is no consideration for the provider of of the services, there is no contract. So I assume you mean $1 gig is "free".

Taking a short Philadelphia (no offense meant to the wonderful folks from the City of Brotherly Love as I'm simply repeating a term already stated) view of the entire contract process is typical and understandable.

Consideration takes on as many forms as does intent or probable cause.

A well written contract has tremendous value and business application above and beyond the simplistic scope of a Judge Judy decision.

The contact states what's expected of both sides in order to perform or exclusively reserve a date and time and what the ramifications might be if not met, such as refusing to set up or being unable to set up;

It provides the ideal documentation to prove actual expenses paid out in the case of recognized IRS deduction procedures for a legitimate freebee;

It provides the needed proof that this event was real and legitimate to the carriers of liability insurance protection should some action arise that brings questions of authenticity to bear;

It provides for a clear cut business image and lays the solid ground work for future dealings, unpaid or paid, as opposed to the air of a gun-slinger good ol guy/gal.

My exact feelings of a mobile DJ doing any event without a contract far exceed the insane term used but in the interest of trying to be forum friendly, it was toned down.

Thanks for reading.

Let me try a different approach.

Does Texas require businesses to charge state sales tax?

For example, if you buy a car, is there sales tax? If you hire a legitimate plumber who fixes your toilet, do they charge you state sales tax on the labor as well as the parts?

Do you own your business or work for someone else?

I don't know how it works in other states but in Virginia sales tax can not be applied to labor or services only hard or consumable goods. The income itself is taxed by both the state and fed!

Here in NY service labor is subject to state sales tax. Plumbers, painters, landscapers, car repairs, all must charge and collect state sales tax on their labor. The also must pay state and federal taxes on the income, excluding the sales taxes.

Once every quarter, collected sales taxes are to be reported, filed, and sent to the state.

Some services, however are not subject to this tax. Doctors, lawyers, and DJs to name several.

Here's one of those ironic things. If a client hires me, Cap Capello, to provide background music, announcements, and sound for a convention, there's no tax as it is considered a DJ service. If they want me to provide mics, sound systems, and maybe background music for a convention, then my other a/v company takes it on and there's sales tax on the total amount.

Cap,

If you are terming these as rentals, we do have to collect sales tax for rentals as well!

Thunder : There again is that fine line small business owners must walk in order to be on the up and up. Then again, no wonder companies and small organizations find it cheaper to hire a DJ, provide the music list, and do all the MCing themselves. It's far less expensive then hiring an a/v outfit, plus the DJ delivers, sets, strikes, and hauls away too.

Yes, Texas has a state sales tax the combined total of state, city, county, and transit taxes can not exceed 8.250%. Yes it is charged on vehicles, and yes I would if I did work for an entity that is not tax exempt.

Matthew: Sounds as though you're fairly new to mobile DJing, and perhaps young with little to no business training nor business background.

Making people conga is a trip. Losing your ass in court due to ignorance is another trip.

Use a contract or agreement of understanding, signed, for every event you do not on your own property. This DJ thing is not like mowing lawns for pocket change. One unfortunate tiny mishap can put you and whatever assets you now own or might have, in jeopardy.

It is insane to do any legitimate event, even a free one or for immediate family, without a contract. I repeat...INSANE!

yes you are 100% correct, im very new and young, I will most definatly have a contract for gigs i do, i have one I have created from a few I have seen online, however the only gigs i have done did not need one just a "bill". I took 2 buisness class' in high school and that has helped and I know what I have to loose if something did go wrong. I as well as all my equipment is fully insured so thats a plus, i have a $50 deductable so the speaker stand i lost only costs $30 to replace so its not worth the paper work or hastle and getting my rates raised. I did of course get a police report since it was a bar fight and is required by my sister no matter how big the fight the police get called.

Gotta love them bar fights.

When I was a cop in LA, I had a slow response time philosophy to bar fights. In order to keep my uniform neat and tidy at all times and at all costs (and all body parts in place and unbroken), drive slowly to the call, and when arriving (general after it was over), take the winners to jail, send the losers to the hospital, and write a nice report for the bar owner's insurance company.

yah was good untill he took out my stand haha, he started a little fight earlier in the night as well but it was taken care of than he did it again but this time it was between about 5 different people, my speaker never stood a chance.

Who is Motel Williams? I've been told Ming The Merciless from Flash Gordan fame, but never heard of this Williams dude. I'll Goggle him.
