The problem with this is that in a lot of cases the Client does not care so it is up to the Vendor to decide the next move. In a lot of cases the Vendors believe that what is written is legal so they do not complain. A private entity who provides only to their registered members and does not cater to the regular public may be exempt but a Venue that caters to everyone is in fact not treating everyone fairly. Again, I am sure that more than likely they have not ever been challenged about this so they continue doing it. I am going to ask someone who I know that is a Business and Corporate Attorney this question the next time I see him, maybe tomorrow evening. He should be at a Birthday Party I am doing tomorrow afternoon.I have played at a venue that charged the B&G an extra $250 per non preferred vendor they used. I then had to have a meeting with the venue coordinator and show my proof of insurance and sign/agree to follow their house rules. Here is a copy n paste from their websites FAQ

Lets face it, what if I wanted to rent the place wanted to have a DJ that is a Caribbean DJ who specializes in Reggae, Soca and Calypso Music. If the Venue cannot provide that kind of DJ why would I then have to pay extra to bring my own? What is I am not happy with the DJ they provided, what recourse would I have. I bet anything that those type of venues will dictate to you how you should dress! They shouldn't because they are not your employer and you are not their employee.
