I just loaded my first videos on to my youtube channel and it made me think about something. I always ask the New couple if they mind if I use the photos or video I take on my website and on facebook but I have never had it in writing. I have yet for someone to tell me no.

Do you have a spot on your contract about this? I just added one. But wanted to get others thoughts.

Here is what mine says.

Section 11. Use of Material ______ ______

Please Circle the correct option.

use photos or videos of my event to promote his business on the internet including but not limited to the company website, facebook, youtube or any other online sites.

That might be a better way to do it. And then verbally keep asking. Just as a common courtesy.

This is the way to do it....

Just going to add a bit to Steve's post.

And if you have any video/photographic content that you feel may be slightly questionable or possibly embarrasing towards the subjects filmed or photographed, don't even make it public in the first place.
 
The CLIENT grants DKH Entertainment Group unconditional release of the use of
photographs, audio or video recordings taken at event described herein for the purpose of DKH Entertainment Group advertising or promotion.
 
even in a contract, you can still be taken to court so be careful

Just blur the faces of those who have not given you permission. Thats how we did it at the Resort and those were naked pictures. Why complicate a simple issue? :trirolleyes: :triwink:
 
If I were to use verbiage in my contract for the purpose, it would probably be similar to examples given, but I don't take pictures myself at gigs - every shot I have on my site has been taken by the photographer at the event. That being the case, I have been riding piggy-back on the releases the photographer gets to allow them to use photos for promotional purposes (ie allowing me to display with credits and links back to them), and their rights to the shots as the copyright holder.
 
I take pictures but I don't have them on any site. I do however inform the client that I may be taking pictures and that they are welcome to a copy of them. I also tell them that I may show them to other clients.
 
As far as photography goes, my understanding is that clients can't sign away the rights of their guests. You would need to get a photographic release of everyone in the photos. I would imagine videography to be no different.

I personally would not be happy if a vendor at my wedding published photos or video without asking first. I would NOT grant permission to post publicly, but would consider on an individual basis using the photo/video for internal/prospective client usage.

I'm a bit shocked that there aren't more complaints by clients over the liberties taken by their DJs.

Now a days with social networking, I think most people understand that you are going to have your picture taken at events like weddings, sporting events etc. As long as it isn't anything that shows them in a bad situation, most I assume don't have a problem with it.

But, as with everything, it is all on an individual basis.
 
I just want to ask a devil's advocate question.

If we can't use photos because folks who haven't given a release are in them, most likely the same is true with videos. And I know I'm not even going to contemplate having someone show up at a reception to "check us out."

How in the world are we supposed to back up what we say we can do?

What if someone was not "supposed" to be at that Event and their spouse/other saw the photo with them in it online? If you did not get permission from THAT person in the pic then yer up a creek without a paddle!

Give References with Names and Phone Numbers so you can be checked out. Anyone can post "Stock" Photos and Fake Testimonials on any website.
