It's complicated Hank. At the time of my quote above (two years ago) I was promised something that never materialized until last week.
This issue will be fully retcified in a couple of weeks and then I can tell you or anyone else more at that time.

I would have just sent them a bill for the use of the photos and add charges for hiring said copyright
if they dont pay it then they are liable for damages and loss of income of said photo that you had on your site
now saying loss of income is good because thier using yours most people would be searchiong for said name and they would have shown yours (on thier site) and you was making money from your site to keep it all working and getting work from displaying them
now being this way the judge can see your the small person trying to do the right thing and the place that took a copy (of your back yard as well) knowing that it was from there - they can be up for the hire charge on said pic(s)

Sad thing is, if you were to take legal action the lawyers wind up with most of the $$ and how long would it be tied up in the courts.

the "other retailer" may want to get involved in "informing" this company of their "error"
as for the picture itself, I'd say with your OTHER pics of your backyard, it would be easy to prove.

No anchor here....too flimsy. An anchor would just tear it apart. I use an 8' tripod if wind is an issue. If its still an issue, then no charge.
