Law Suit Filed Over Wedding Floral Centerpieces

NEW YORK - The wedding was lovely, except for the flowers: They were the wrong color.
So says the bride, Elana Glatt, who was so upset that she sued the florist and alleged breach of contract.
She says Posy Floral Design in Manhattan substituted pastel pink and green hydrangeas for the dark rust and green ones she had specified for 22 centerpieces.
Not only that, she alleges that the hydrangeas were wilted and brown, and arranged in dusty vases without enough water.
“The use of predominantly pastel centerpieces had a significant impact on the look of the room and was entirely inconsistent with the vision the plaintiffs had bargained for,” Glatt, a lawyer, said in the lawsuit, filed on behalf of herself, her husband, David, and her mother-in-law, Tobi Glatt, who paid for the flowers.
The flowers cost $27,435.14. The lawsuit asks for more than $400,000 in restitution and damages.
Stamos Arakas, the florist, said that he and his wife, Paula, tried to match the color of the hydrangeas with a picture Glatt had given them, but explained to her that the colors might not look the same.
“My father used to tell me, ‘Don’t deal with the lawyers,” Arakas said. “Maybe he was right, God bless his soul.”

DJ Zac : Liability insurance does not cover this as it relates to this business. You would have to carry Performance Insurance (similar to Malpractice Insurance) which runs between $5K - 15K a year depending on exposure.
IMHO, insurance is the biggest scam this side of Nigeria or Vegas...

Hopefully yes, and it includes a limit of liability clause, that all the contract clauses are upholdable or at least has the Failed Clause limitation inclusion, and that the signatures are binding.

Cap - It depends on how the lawyer words his Action.......If the plaintiff alleges damages or injury (physical or not) caused by the failure to perform, or simply alleges negligence...the liability policy could be pulled in. Lawyers, if they know a specific policy is in force will craft the pleadings so as to make the policy respond......It's easier to get money from a liability insurer than the defendant directly....
That being said if the value of the flowers formed part of the claim, this would certainly be excluded as liability policies typically exclude "your work/product", but possibly not the resultant damage/injury.
Cap - No argument! I guess my point was that no matter what, there is ALWAYS the potential for a lawsuit. You can minimize your exposure, but someone intent on suing you will find a reason...
Bet they hired the cheapest DJ they could find cause after paying that much for dead flowers... they probably couldn't afford a good one.
