What if this was a PRIVATE RADIO NETWORK, requiring a membership, to keep out the public at large, to hear promotional music etc??????
I like the idea Dan, let's just figure out the legality stuff. Maybe Doug is right and we may have a private "lounge" for said activity. The fun thing is all of us (individually) probably own a copy of 85-90% of what would be broadcast.
I think if it could be done like an on line conference, where we audition new hot regional music, demonstrate mixing styles, announcing techniques etc... and get away from a "radio station" concept, perhaps that might be acceptable???
Do the first conference live, but record for playback for repeat broadcasts. Set up different segments each on a specialty and then perhaps every so often do blocks of best or or most requested segments.... just an idea. Any way you look at it, it will take a lot of time and some storage space.

On the blog talk radio I do we can get written permission from the artist to play the song....but it really does get complicated so at times its not worth it. So many of us went the route of local bands and artists....get written permission from them...they have nothing to lose if people from around the world hear them and everything to possible gain. Many times they are eager to do this as a way of promotion....just a thought
There is no exceptions for the ASCAP, BMI, SESAC licensing. a "private lounge" will not get you past it because your set up is never really private. You would still need permission from the people that wrote the song.

If you have invited private friends...how can they say you are public??
Also...if someone steals your stream...how is this your fault??
Yes someone may rain on the parade..but they would have some major technological questions in point to prove beyond a doubt..you used the music for financial gain!
I see the worries..however...there are bigger fish in the ocean. If there became an issue...this case could go two ways....and that means it is a deadlock...and you just dont do it anymore, because new provisions will be made.
I see your point...but they would have to prove public...and public is becoming a hard thing to define with all of the new technological advances. I personally think there is too many exceptions to the rule, and a prosecutor would have a tough time proving ill will!

Dr Drax is pretty much on the money here... although the likely hood of being busted as it were is very minimal the chance is still there without the proper licensing.... Like a Bar or Club that has a jukebox, DJ, or a live band has to pay these licenses so would ODJT or whomever was serving the music.
The minute you post a link to it in a forum like this it becomes public and even if you don't it is still searchable.
Just look at the Pod Casts that the DJA Radio put out now they use to have music from national acts as a backdrop to their show and now can only use publicly licensed music and effects for their show or stuff they create themselves...

I say go for it and if someone crys wolf and ya get a cease and desist order then you stop. They'll be nice at first before they attempt to slap the cuffs on ya and drag your happy ass to court. Especially because they'd stand a good chance of loosing and setting precedents they don't want.

Financial gain doesn't matter. Pay attention the next time you rent a DVD. actually read the copyright on it. They prosecute even where there is no financial gain.
I agree that getting caught might be unlikely, but the risk exsists & there is nothing requiring them to stop at a C&D letter. If you infringe they can come after you for damages.

We have been on for almost a year and we have had no problems what so ever. We have been flying under the radar so far but if one day they ask us to stop, we will. If anyone wants to stream and not take the chance you are welcomed to join us if you want.
Not only the ones who wrote it but sang it ...cause we all know that at times its different and produced it and well you get the pic....they all want a piece of the pie. Thats why it just wasnt worth trying to get them music from the big stars.....
But local guys and gals jumped at the chance.....many even have a good song or two...that Ive played at events....and had good success....so less hoop jumping to get the rights to do it with these folks.....

Bottom line....defining public would certainly be an issue with all the technological advances.
I'm going to abide by the rules because it's the right thing to do, even if I don't think the whole setup is Kosher. I think it's pretty crappy though every thing I've read points to the ASCAP & BMI having virtually unfeathered power when it comes to suing the socks right off your feet. They don't release any numbers most of what I've read said the artist gets jack when when compared to what's collected.
Here I'm just thinking it would be a fun thing to blow off some of the winter blues and get to know each other more but I'd have to worry about the sharks coming after me, even though I know full well I'd probably never get caught it's still one of those hanging over your head things and really isn't the right thing to do. If the license were affordable I'd be all for it but hundreds possibly thousands of dollars for a little fun is ludicrous.
