I would still follow through with a lawyer. Too much funny business, and the logo steal was over-the-top. And yes, trademark and servicemark (which is what it really is in our business, unless you sell hard product like CD players or such) are tricky subjects, but you've got enough proof there to at least open the case for harm to your reputation, and possibly "restraint of trade."

That's my point - for you to truly protect it, the watermark usually 'ruins' the image. You can obtain flash images and media without making screenshots.

Reality dictates that if someone would rather use your stuff than take the time to make / build their own, they will try to find a way to do it.

I do watermark all of the photos on my site / facebook. Some might say it's too much / ugly, but it's at about 10% transparency and exactly the same on every photo site-wide.

My photos are better than pretty much those on any competitor's site in the area, and I'm not about to have them ripped off. As long as things look professional and consistent, I wouldn't worry about it.
