I wasn't privvy to the discussions but I think that's basically what happened to my old boss. Once they had the tooling setup, there was virtually no way for him to enforce a cease & desist. I don't remember if he actually moved his production elsewhere but I do remember him almost blowing a gasket when he found out what they were doing with his product.
