Jury Duty?

I just turned 18. I have a Halloween party that is paying $400 on October 26th. I dropped $500 on some new equipment to actually do the gig and get it done. Right now, I had $300 already. So I'm in debt currently at $200 with my parents until I do the Halloween gig. Everything is signed, confirmed, and ready to go. It's a company gig. This gig is probably going to bring in a lot more business for me and get my name out there big time. This'll help me a lot for college next year, I'll be attending soon and some extra cash will help from this gig and the others it may bring. I don't drive yet, so my father is bringing me to the gig. No biggie. Everything will work out well paying me $200 and whatever else I get from additional jobs.

Here is the big problem though. I was called for jury duty that day. I called, and they will not excuse me for that day since I'm not attending college this year. The place it's being held is 30 miles away!

This is going to make me broke. I'm gonna be in debt, lose my money, and probably lose future gigs. Not to mention I can't get there, my father can't drive me all the way there and back. What am I supposed to do? They only want to pay me $15 damn dollars for the day! Barely would cover gas if I DID drive. Not even close for a taxi. I can't afford this! Can't can't can't! I'm barely squeezing by this one as it is...

How were you planning on getting to the Gig?
 
What you may have to do is find what court and judge the case will be in, if they can even tell you, and write the judge directly. Here where I am, you can get out of jury duty if you have a good reason that can be backed up...they don't consider transportation to be a good reason, but a legally binding contract that was signed before the jury summons was received would most likely work.

One of the other things you can/might have to do is go to the courthouse that day and explain to the judge in person why you can't do it. They might let you out of it.

I don't know how I could actually get there though. My dad can drive me to the gig but that is only 2 miles away. I have no way to get there 30 miles away and back...I'm extremely limited when it comes to transportation...

You were not "excused" from jury duty...which would mean you did not have to go at all. The list of "excuses" is very limited by design.

However, you may be able to ask for a "deferment"...that means that you will have to report to jury duty at a future date. You are asking to re-schedule the date of your jury duty. The specific details will depend on your area. In my state, the first deferment is "automatic." All you have to do is return the jury summons card asking for a deferment.

I don't know what you can do about your situation with jury duty since you never mentioned where you live. Do you have a friend who could take you there and get back on time to do the gig? What time is the gig? You also assume a lot about what this gig will bring you. You say this gig will get you many more gigs. If you do the gig I hope that is the case but there are no way you can be for certain that will happen. Can you please tell us what gear you're going to use to do this gig?
 
If you have a singed contract you should go to the court house before that date and show it to the clerk. They will reschedule you date and you will be fine. I have done this once before in Philadelphia and had no issues. If you do not have a contract get one.

Let me address the first issue. If they've called you for jury duty, and have denied your hardship request to be excused, you'll either show up or the judge will issue a bench warrant for your arrest, period. DO NOT just ignore this as it is a jail-able offense. Now past that, were I you, I'd ask to speak with the judge. Calmly and politely explain your situation and tell him just what you've told us, emphasizing the fact that your livelihood is what's being compromised. You are self-employed and jury duty is preventing you from making a living. Don't bother telling him about how it doesn't cover your transportation as he's not going to care about that. Good luck.

95% of the time you will not be chosen to be on a panel. And if you are, 80% of those set for trial plead out before the trial begins. At least this has been my experience.

Not mine. I've only been called once, but in each case we had to show up and go through the selection process. During our week to be on jury duty, I served on 2 juries. I think I was only bypassed on one case.

Hey, I was a jury foreman once :)

Couple of them I did.

Lesson I learned, send them back a letter, telling them you are a white supremacist Nazi, and they will never bother you again ;)

So I called them today, explained that "I am self employed as a DJ, and missing my work for the day can cause financial problems since it also gives me advertisement to continue future employment since that is how the DJ business flows". They told me they would try to reschedule me for another time and to wait for a call back status. Otherwise I would need to report that Saturday. Or I could come down there to talk to them in person, and talk to the scheduling department, which usually gives better results. I did not mention the transportation issues...

This is a killer. I CAN'T get there. If I have to get there, I'm gonna loose money. And right now, I don't HAVE money to get there if I wanted to. During these times, do people NOT understand some people are living paycheck to paycheck. A taxi is too expensive for 30 miles there/back. Dad can't drive me that far. I have no friends that drive either (because we just can't afford it), and neighbors hate me...If they were able to "pay me" for the long haul there and back for a taxi, then I wouldn't have a problem with it...but to spend my own money, loose money, and future money, this is f___'d up. I hope I don't have to wear anything nice either for jury duty. I don't have anything...

I do this DJ'ing as a hobby, mostly a way to get me some extra money for college. This is ridiculous...my only way to try to get to college and something governmental screws it up...

Unfortunately, we do not have a signed contract for this gig. I've been doing this one for 5 years now, he understands, we know each other, and I don't have any problems with him.

And as a side note: Does it really matter what equipment I'm using? If it gets the job done, people have a great time...then who cares? My equipment has been going for 6 years now. Only reason I had to drop $500 for some stuff is because my 2 amplifiers got hit by a power surge during a thunderstorm...I lost my TV also, cable box, and my window AC. TV I had an extra one thankfully, cable box the cable company replaced for free, and AC I picked one up at a yard sale :p

My amps "were" Seismic Audio and Gem Sound. I picked up 2 more SA amps. The SA amp was still making noise but distorted, the gem sound was dead as a nail. So I decided to buy new ones. I also have SA speakers, and a Numark mixer, Numark rack mount CD player, and a laptop with VDJ...

Well then....argh...I've never been so annoyed before.
 
Dude, I applaud you for trying to make some money to take yourself through College. Bear in mind that to get the good paying Gigs will entail having decent gear and keeping up with your Music Library. That will take a big bite out of your money. The attitude that you will use whatever to get through whenever is not a good one to employ. It will do no good for you and the business as a whole. People are here willing to help you but you have to do your part and listen to advice. Had it not been for the College thing I probably would have passed on this thread. You caught my attention and respect. Instead of looking upon what you do as a hobby, look upon it as a Part Time Business and treat it as such. If it continues to bring you revenue then keep doing it. If you are making less money than time and dollars you are spending then be realistic and just go find a job. Where are you getting your music?

First I asked about the gear as for me it makes a big difference what I use. Now I get that you don't have a lot of money and that things are tough. Things are tough for a lot of people. With that being said I would look to upgrade when you can your gear if you plan to stay with DJing. I would suggest you get a Furman power conditioner so that will protect your gear from such an issue. You can get 1 for less then $100.00 at Guitar Center. I have 2 in a rack.

I live in New Jersey. Where do you live? You have some serious issues. You said you hope you don't have to dress up to do this jury duty. What do you wear when doing gigs? I just finished doing my best friends wife 50th birthday party and I wore a tux. You said that you want to do this gig because it will get you more gigs. Then you went on to say you've been doing this gig for 6 years. If you've been doing that gig for that long you should already have gigs lined up from what you've done in the past. Now since you say you don't have plenty of money right now I would suggest that you can go to a Goodwill store or something like that and find you some nice clothes to wear. Don't laugh people. They do have some clothes in there that don't look bad at all.

You said you DJ as a hobby and yet you're looking to do this to support you making it through collage. If you're looking for this to support you through collage then I would suggest you take it more seriously. Also not having a signed contract is a big no no. Especially since you said this is a corporate party. Do you even have a contract for a client to look over and sign if they want to book you? Not trying to bust your chops but just giving some advice here.

Lastly you said what difference does it make what gear you use? It makes a BIG difference! Now mind you the 2 Yamaha powered tops and subs I bought cost me $3,000.00. Some will say wow that's a lot of money to spend on speakers. It was but the compliments I get about how it sounds were well worth it. Besides I bought those speakers because I know I wanted some really good gear to work with that I know I would be happy with and not looking to quickly sell the stuff looking to get better speakers. I bought those speakers knowing I was going to want to keep them possibly till I retire from DJing. Now I did this because of my years of experience as a DJ. I could have opted to get something that would get me by but I wanted more then something like that.
 
You can be excused from Jury Duty if your boss sends a letter explaining that you are needed.
There's no reason that being "self employed" wouldn't hold the same value...
especially if you are already financially obligated. (proof of a deposit)

That is good advice. You have 6 weeks to make a trip to the courthouse. If you do not get a phone call in the next week or two, I would start planning for a trip to the court clerk to see about being rescheduled.

Everyone who is called for jury duty is inconvenienced. But being able to be called for jury duty is a privilege. The pay for jury duty has always been a token amount. Be happy with $15. The last time I was on a jury, the pay was $6 per day....and parking was $10 per day.

In terms of the dress code...think "business casual," or "Sunday church service," or "job interview," or "first date," or "meet the date's father"....according to whatever you think makes you look the most responsible. Dress like you WANT to be picked.

Pants that are not jeans, that are a solid color, and in good repair (no holes or rips...deliberate or otherwise)....khakis or dress pants are fine...athletic pants, camo pant, and shorts are not fine. A shirt with a collar and sleeves, without any obvious logos, long sleeved or short sleeved according to the weather...a polo shirt, or a button down the front shirt are fine...team jerseys, concert tee-shirts, and "wife beaters" are not fine. Tuck the shirt in. Any "dark" or "neutral" color shoes that are closed toe are fine....walking shoes or even work boots (if clean) are fine....neon running shoes, sandals, flip-flops are not fine. If the shoes can be shined...make sure they are shined. If you need a coat or jacket, pick one without any obvious logos, in a solid color. Leave any hats at home (unless they are religious headwear).

Nothing is screwed up at this point. You have almost 6 weeks to find some compromise. You have 6 weeks to reschedule the jury duty date. You have 6 weeks to hustle and earn enough money to cover the taxi ride. You have 6 weeks to find someone with a car who can drive you and arrange a barter of some kind. You should be working on more than one of those options at a time.

You may be overestimating the "future business" that will come from this one party. While I am often hired by people who have seen me perform live, the overall conversion rate is VERY low (1 or 2 booked gigs from every 1000 people who see me...??? That's a number I made up, but feels about right). I would start lining up other gigs NOW. There will be some Holiday parties coming that can help bring in other $$$. What are you doing to advertise your new business? What are you doing to meet your next client?

Before you do anything else, get a signed contract. Even if it doesn't help with this specific case, it will help in the future.

Yes and no. Equipment needs to be reliable and get the job done. That's #1. BUT, better gear tends to be more reliable and do a better job. There is very little to recommend in the <$3000 price range for a "full setup." So, make money with what you have now, and save some something better down the line.

Dude. You're 18. Give it another 10 years and this won't even register in terms of annoyances. o_O

If you don't have a business license with your state and county then don't expect them to believe you are self employed. You need proof, if you had a copy of business licenses and a signed contract you would be rescheduled for a future date. You should plan on attending jury duty, it doesn't sound like you have a valid excuse or proof.

The specific rules about business licenses vary from state to state. There is no license required in my state to do any business under your own name. If you want to do business under a "business name" as a "sole proprietorship" you do need to file a "Doing
Business As" (DBA). The DBA needs to be filed in all the counties where you will do business. This creates a legal link between your name and the business name. I did have to show the DBA to the bank to open a business checking account. If you want to setup an S-corporation or Partnership...then there is more/different paperwork. That's in my state. Your state may be different.

In my state, you can "reschedule" or "deffer" jury duty once without any formal "proof" or "reason" needed. I have done this several times over the years due to business travel, job deadlines, and personal vacation plans. Your state may be different.
